Before purchasing, you must confirm your acceptance of these terms and conditions
when you place your order.

1. Introduction

1.1. These Terms and Conditions ("Terms") govern the use of the waEV-charge website and services, as operated by House Group Developments ("we", "us", "our"). By accessing our website or purchasing our products and services, you agree to comply with and be bound by these Terms.
1.2. Please read these Terms carefully. If you do not agree with any part, you must not use our website or services.

2. Definitions

2.1. "Customer" refers to any person or entity that purchases or uses our products and services.
2.2. "Services" refers to the supply, installation, and maintenance of electric vehicle (EV) charging solutions.

3. Use of Our Website

3.1. By using our website, you confirm that you are at least 18 years old or have the consent of a parent or legal guardian.
3.2. You agree not to misuse our website, including by introducing viruses, hacking, or attempting unauthorised access.
3.3. We reserve the right to suspend or terminate access to our website at our sole discretion.

4. Products and Services

4.1. All products and services are subject to availability. We reserve the right to modify or discontinue any product or service without prior notice.
4.2. Product images on our website are for illustrative purposes only. The actual product may vary slightly in appearance.
4.3. Installation services are subject to a site survey. Additional charges may apply if the installation requirements differ from the standard specification.

5. Installation Services

5.1. The EV charging installation industry widely adopts the term ‘standard installation’ which defines installers preset scope of works for a charger to be installed, please find what’s included with a standard installation below;

• Includes up to 10 meters of cable to connect the waEV-charge unit to your distribution board or electric meter.
• The cable is clipped directly to the wall, and the process includes the drilling through of a single wall. Additionally, if your distribution board/electric meter are located internally, we include 1 meter of trunking.
• Installation of a B40 or C40 DP Type A RCBO consumer unit.
• Your installation also comes with a Surge Protection Device as standard to safeguard your system. After installation, the EV charger is fully set up and commissioned, and you’ll receive a copy of the electrical certificate detailing the work completed.
• Where applicable, we also handle building control notifications, giving you a simple and compliant installation experience.

6. Requirements and Conditions

6.1. The home charger must be located for use in your specific designated off street parking with no charging cables trailing over any potential footpaths which could lead to a safety issue. If your parking is deemed to not be off street but have stated you do have off street parking on your remote survey, you will be liable for any time incurred from the engineers if they are only made aware when arriving on the site.
6.2. waEV-charge offer a standard installation package which the requirements are made clear above. If any installation falls outside of the installation remit, the installation may have to be put on hold and a quote for the extra works required
would be made.
6.3. Our engineers will attempt in every way to choose the best and most aesthetically pleasing cable route for the installation, however if an engineer deems any part of the installation to be unsafe, they have full disclosure to halt any works on those grounds if they are unable to find an alternative route which would be deemed safe.
6.4. Our engineers also have full disclosure to determine safe working practises. Extreme weather, working in lofts or on roofs, or working in tight crawl spaces can all be included in an engineer’s original risk assessment to determine safe working conditions.

7. Lead Times

7.1. waEV-charge will provide suggested installation dates when you request a quotation, these dates are not guaranteed nor are waEV-charge responsible for any public charging costs incurred if the date stated on the quotation is not fulfilled. Furthermore, this also applies to any dates then provided directly to the customer as a variation of scenarios can potentially impact the installation date.
7.2. We work toward a lead time of 2-3 weeks, this time starts from when you have completed your remote survey as at this stage in the process, we then have the information we require.
7.3. waEV-charge will not compensate for indirect or consequential losses for missed appointments causing loss of earnings and/or for example public charging costs incurred whilst the waEV-charge unit is unable to be used due to not being installed yet.
7.4. waEV-charge reserves the right to provide gestures of goodwill should they choose too.

8. Solar Charging

8.1. Our primary solar offering involves accessing your export data by default. If this is not possible, we will utilise our solar irradiance software to identify any surplus solar energy. Please be aware that we cannot guarantee the accuracy of data we receive from the export data or the solar irradiance software, which may occasionally result in grid charging, even if 'solar only mode' is activated.

9. Pricing and Payment

9.1. Prices for our products and services are displayed in GBP and include VAT unless otherwise stated.
9.2. Payment is required in full prior to the delivery or installation of our products unless an alternative arrangement has been agreed in writing.
9.3. We reserve the right to amend our prices at any time. Changes will not affect orders that have already been confirmed.
9.4. Finance options are available for installation orders only. Product-only purchases are not eligible for finance.
9.5. Any discount or promotional voucher must be applied by the customer at the time of placing the order. We are unable to retrospectively apply vouchers, discounts, or issue equivalent value (such as Amazon vouchers) after the order has been confirmed.
9.6. Amazon vouchers for qualifying referrals are issued within 28 days of the referred customer’s installation being completed. Referrals that do not result in a completed installation will not qualify for the reward.
9.7. Finance orders are deemed complete once installation has been successfully carried out and confirmed by our installation team.
9.8. We reserve the right to modify, withdraw, or update promotional offers and referral schemes at any time without prior notice.

10. Returns & Refunds including Cooling off period

10.1. Upon purchase of a waEV-charge product, you receive a 30 period to which if you changed your mind and wanted to cancel you can do so without reason. This period starts from the date of purchase

11. Cancellation Before the Installation of Your Home Charger

11.1. You can contact us via any of our communication channels to cancel your order, our team will then walk through the process to return the charger (if it has been delivered) once the goods have been received, we will refund to you any money due, if you had not received delivery of the charger already, the refund would be processed immediately. If your waEV-charge product has been installed, you would be responsible for the costs associated with the removal of the product from the property, as well as the original installation costs.

12. Cancellation After Installation of Your Home Charger

If you choose to cancel this contract during the cooling-off period, but the installation of your home charger has already begun or is complete:

• If the installation services are not fully completed at the time you notify us of your cancellation, we may charge you for any installation work completed up to the point of cancellation.
• If the installation services are fully completed, you will not be able to cancel the
installation services, and you will be liable for the full installation costs as well as
any charger removal costs incurred.

In both scenarios, you retain the right to cancel your order for the home charger itself, and you will be entitled to a refund for the charger. However, you will be responsible for covering all or part of the installation costs, as outlined above, as well as the costs associated with removing the charger (including labour) and returning it to us. Additionally, we may deduct a reasonable amount from your refund to account for any reduction in the value of the charger due to installation or use.

13. Warranties

13.1 Standard Manufacturer Warranty

waEV-charge warrants each EV charger (tethered or untethered) against defects in materials and workmanship for 36 months from the date of supply or installation. This includes all core components under normal residential or commercial usage

13.2 Ancillaries Warranty

Materials installed alongside the charger (e.g., consumer unit, cabling & connection box) are covered by a 12-month warranty.

13.3 Extended Warranty

A written agreement may extend coverage up to 60 months, this is only applicable to the EV charger and not materials used.

13.4 Scope of Coverage

Includes parts and labour for repair or replacement of faulty components due to manufacturing or workmanship defects.

13.5 Exclusions

This warranty excludes issues resulting from:

• Misuse, neglect, damage, or accidents
• Unauthorized modifications or repairs
• Installation by unqualified personnel
• Extreme weather, misuse, vandalism, or normal wear-and-tear

13.6 Claim Procedure

Notify waEV-charge when noticing an issue. Claims must include proof of purchase, the installation date, and details of the defect. Valid claims will be diagnosed and remedied at no charge. waEV-charge endeavours to have all warranty claims repaired and operational within 7-14 working days.

13.7 Labour and on-Site Repair

Genuine warranty faults include labour and travel costs. If a claim is invalid or outside coverage, labour and parts will be invoiced.

13.8 Liability Limitation

Liability is limited to repair or replacement under this warranty. waEV-charge will not compensate for indirect or consequential losses from charger failure for example public charging costs incurred whilst the waEV-charge unit is unable to be used

14. Limitation of Liability

14.1. We are not liable for any indirect, incidental, or consequential damages arising from the use of our products or services.
14.2. Our total liability in connection with any claim shall not exceed the amount paid by the Customer for the relevant product or service.

15. Intellectual Property

15.1. All content on our website, including text, images, and trademarks, is owned by or licensed to us. You may not reproduce or redistribute any content without our prior written consent.

16. Data Protection

16.1. We process personal data in accordance with our Privacy Policy, which is available on our website.
16.2. By using our services, you consent to the collection and use of your data as outlined in the Privacy Policy.

17. Marketing Preferences

17.1 By engaging with waEV-charge, you may be given the option to subscribe to marketing communications, including updates on new products, offers, and services that may be of interest to you.

17.2 You can choose how you want to receive these communications via email, SMS, post, or phone and can manage your preferences at any time by using the unsubscribe link in our emails, or by contacting us directly.

17.3 We will never sell your data to third parties. From time to time, we may share your details with trusted service partners who help us deliver our communications, but only where they act under our instructions and comply with our privacy standards.

17.4 You have the right to opt out of marketing communications at any time, and this will not affect your access to our products or services.

18. Governing Law and Jurisdiction

18.1. These Terms are governed by and construed in accordance with the laws of England and Wales.
18.2. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

19.1. We reserve the right to update or amend these Terms at any time. The latest version will be published on our website.
19.2. Continued use of our website and services constitutes acceptance of the updated Terms.

21. waEV Smart Terms & Conditions

Introduction

Please read these Terms and Conditions carefully. These Terms and Conditions apply to the WaEV Smart (the “Service”). By entering the Service, you agree to be bound by the following Terms and Conditions.

These Terms and Conditions, together with any specific rules set out in any communications relating to the Service, are the Service rules (“Rules”) and apply to this Service. By entering this Service, you are agreeing to be bound by these Rules and any other applicable instructions.

Changes to these Terms will take effect from the date they are published and, where those changes are material, we will also endeavour to provide you with prior reasonable notice via a notification or publication on our website or by email. It is your obligation to ensure that you have read, understood and agreed to the most recent Terms available.

In the event of any dispute regarding any aspect of the Service, the decision of WaEV shall be final and binding.

By accepting these Terms and Conditions, you consent that you allow WaEV and our partners to access your connected WaEV devices (“Flexible Devices”) for us to deliver the Services. A full explanation and description of the Service is set out below.

Definitions

In these Terms and Conditions, the following words have the following meanings:

"Account"

The setting up of an account by completing the registration process on the WaEV website or other approved registration channel.

"Account Holder"

The individual or entity that has set up an Account and registered for the Service.

"Baseline"

Where applicable, the reference level of electricity import and/or export calculated using Smart Meter or Flexible Devices data in accordance with the relevant Programme Operator Terms.

"Data Protection Laws"

All relevant data protection laws, regulations and rules which may apply to the Parties, including but not limited to the UK Data Protection Act 2018, the General Data Protection Regulation 2016/679, and the Privacy and Electronic Communications (EC Directive) Regulations 2003. "Personal Data" and "Personal Sensitive Data" shall mean as defined within the Data Protection Laws.

"DCC"

The database of Smart DCC Ltd, regulated by Ofgem.

"DNOs"

Electricity distribution network operators and includes references to local network flexibility procured by them.

"Energy Services"

The provision or procurement of services supporting a decentralised energy system, including energy, flexibility, balancing and capacity services.

"Event"

A period during which Flexible Devices are adjusted, scheduled or controlled in connection with the Service.

"Flexible Devices"

Connected devices linked to your Account, including batteries, inverters, heat pumps, electric heaters, electric vehicles and electric vehicle chargers.

"Grid Services"

Electricity balancing and flexibility programmes offered in Great Britain.

"MPAN"

The Metering Point Administration Number identifying an electricity supply point.

"NESO"

The National Energy System Operator for Great Britain.

"Partners"

[Company]'s commercial partners and authorised sub-processors involved in delivering the Service.

"Programme Operator"

Grid and market operators, including NESO and Distribution Network Operators.

"Programme Operator Terms"

The applicable terms and rules of a Programme Operator.

“Rules”

The specific rules set out in any emails, webpages or app surfaces provided to you by WaEV relating to the Service.

"Rewards"

Discretionary rewards granted to you based on participation in Energy Services.

"Services"

Our websites, platforms, software and associated services enabling participation in Energy Services.

"Smart Meter"

A SMETS1 or SMETS2 electricity meter.

Details of the Service

In Great Britain, various Grid Services are offered to help the electricity grid which are managed by Programme Operators. Each programme has its own eligibility criteria and specific rules.

waEV, its partners and data sub-processors, including but not limited to Axle Energy Limited (“Partners”) will assess, enroll, manage, and reward Flexible Devices in Grid Services, based on location, technical specifications, preferences, and the availability of such services.

In order for us to deliver the Services we and our Partners will require access to your Flexible Devices.

We automatically enroll your Flexible Devices to support overall grid stability. This will work by briefly adjusting the Flexible Devices’s operation during periods of high stress for the grid. Under normal circumstances, we do not expect this service to materially impact your day-to-day Flexible Device usage, as these adjustments will be infrequent, and pauses or modifications to device operation will be for short periods only.

At other times, Partners will control your Flexible Devices to adjust the overall electrical supply or demand on the network (“Events”). Where necessary, we may automatically vary the rate of production / charge / discharge from your Flexible Devices during or in preparation for Events.

The Service is offered on a best-effort basis, with no guarantee on the frequency of Events or the potential value of rewards due to evolving program rules and market conditions.

The Service and these Terms and Conditions are subject to the applicable terms of the Programme Operators that will also apply and you accept those Programme Operator Terms in order to access those markets, and we accept no liability if the Programme Operators amend or terminate their terms.

The number of Events is not guaranteed, and participants cannot choose which Events to join, though deregistration from the Service is always an option.

Flexible Devices can typically participate in Grid Services with only one provider at a time. Enrolling in our Services, if you are already registered for Grid Services with another provider, will render you ineligible to continue with the previous Grid Services provider. We are not responsible for notifying you of removal from any other service due to dual registrations or for any financial or other consequences arising from such removal.

Registering with another Grid Services provider after joining us may result in disqualification from our Services.

We are not liable for reimbursing any expenses incurred in connection with joining the Service.

You may use the Services only in accordance with these Terms, the Rules and the Programme Operators' terms and conditions (where applicable), and the guidance and instructions applicable to the Services.

This Service is not a financial product or investment and is not regulated by the Financial Services Authority ("FCA").

Rewards

Participation in the WaEV Smart could make you eligible for rewards based on your Flexible Device's performance (“Rewards”). Rewards are not guaranteed and are subject to change.

Any Rewards earned will be credited at least monthly to your Account which is managed by our Partners.

Rewards exceeding £10.00 can be redeemed via bank transfer to a UK bank account in the name of the Account Holder.

For certain programs within the Grid Services, eligibility for Rewards requires achieving a reduction in electricity import or an increase in electricity export to the grid, as measured against a Baseline.

We and our Partners will only pay you revenue from what is received directly from the Programme Operators and accept no liability for unpaid amounts beyond what is received and we cannot ensure that the Service will result in any Reward.

Account Holder eligibility and participation requirements

To be eligible to participate in WaEV Smart and any Energy Services, you must at all times comply with these Terms and Conditions, be 18 or over, and be a resident of Great Britain.

To be eligible, you must have a working electricity Smart Meter that is:

  • actively communicating with the DCC and has done so for a period of at least 30 days prior to requesting to join the service, and
  • have a registered import MPAN, associated with your address in the DCC.

To be eligible to use the Services you are required to:

  • opt-in to the Service, and
  • not be participating in the delivery of Grid Services or any similar service for NESO, any Distribution Network Operator, or other Programme Operators either directly, via an energy supplier, or another third party.

You confirm that you are the bill payer at the address provided during registration, or that you have the authority of the bill payer to enrol the premises.

You confirm that you own the Flexible Devices enrolled in the Service or have full authority from the owner and any other relevant party to enrol and permit control of those devices.

By agreeing to these Terms and Conditions, you consent to:

  • us and our Partners accessing your half-hourly smart meter reads and telemetry data (including but not limited to energy, power, plug-ins, usage, state of charge) from your Flexible Device(s);
  • collecting your MPAN and registering your MPAN and Flexible Device(s) with Programme Operators, including sharing smart meter reads and telemetry data where required to fulfill obligations within Programme Operator Terms; and
  • us exclusively controlling your Flexible Device to deliver the Service during Events and any required preparation periods.

Initial and/or ongoing participation in the Service may require firmware upgrade/s to your Flexible Device, and we reserve the right to remotely update firmware as necessary during the Service. Partners will control your Flexible Device to deliver the Service.

We reserve the right to limit mode availability or decline registration for participants using unsupported modes as certain modes may not be compatible with the Service.

Proper Use of Services

You shall not:

  • Interfere with or disrupt the operation of the Services;
  • Attempt to gain unauthorised access to any system, network, or data;
  • Introduce any virus, malware, or harmful code; or
  • Use the Services in a way that could damage, disable, or impair them.

Liability

We are not responsible for any loss, damage, injury, or incidental, indirect, special, or consequential damages (including, without limitation, lost profits or energy loss) arising from or related to the use or inability to use the Service.

Participation in the Service is at your own risk and is provided on an "as-is," "where-is," and "where-available" basis.

To the fullest extent permitted by law, we disclaim all representations, warranties, and conditions (express, implied, statutory, or otherwise), including but not limited to warranties of merchantability and fitness for a particular purpose regarding the Service.

We in our sole discretion reserve the right to withdraw or vary the Rules and/or any offer made in connection with them in order to comply with the decision of any relevant judicial or regulatory body and shall not be held liable to any participant for doing so.

Termination

You may terminate these Terms at any time by closing your Account and ceasing to use the Services.

If we reasonably believe you have violated the Rules, we reserve the right to disqualify you from the Service and revoke any payments.

We reserve the right to terminate your participation in the Service immediately if any information you have provided is found to be false, inaccurate, incomplete, or misleading. In such cases, any benefits, rewards, or payments associated with your participation may be revoked.

We reserve the right to temporarily suspend or permanently remove your access to the Service at our sole discretion if, at any time during your participation, the following conditions occur:

  • Your Device becomes disconnected from the internet, or your Device is moved to a different location, or
  • Your smart meter is disconnected, your meter readings are no longer available in the DCC, or you relocate to a new property, or
  • You are no longer eligible under the Rules, or
  • A technical, operational, or security risk is identified in relation to your access to the Service.

You may opt out of the Service at any time by emailing [Support Email Address]. Re-registration may not be possible after opting out and is at the discretion of us and our Partners.

We may terminate the Service at any time and for any reason without prior notice.

Upon termination or opting out, we are not obligated to store, maintain, or provide any content, data, or information related to your participation in the Service.

Termination will not affect any rights or obligations that have accrued before the termination date. Any clauses which by their nature are intended to continue beyond termination shall remain in force.

Data Protection and smart meter access

Both parties shall comply with its obligations under the Data Protection Laws and the WaEV’s Privacy Policy found on our website at https://www.waevcharge.co.uk/privacy-policy.

waEV-charge acknowledges and agrees that any Personal Data provided by the Account Holder in connection with the provision of the Services will be processed in accordance with applicable Data Protection Laws and waEV's Privacy Policy.

WaEV shall only process Personal Data as necessary to provide the Services in accordance with these Terms and Conditions.

We will share participants’ email, address, Meter Point Administration Numbers, half-hourly metered energy consumption, energy export, Flexible Device measurements, usage information, records associated with installation and the commissioning process, and other details relating to the participants with Programme Operators, its affiliates and their authorised sub processors to provide the Service including to register participants in the Service, provide evidence of performance, and calculate payments to individual participants.

Your half-hourly metered consumption and export data will be processed by Partners and their authorised sub-processors by interfacing with the national smart meter systems in accordance with the Smart Energy Code. We will only share your smart meter readings once you have provided your consent.

We and our Partners could provide Programme Operators with half hourly electricity consumption, export, baseline and reduction data and the value of any incentives used in an aggregate manner, for the purposes of delivering the Service. In some cases, Programme Operators may request detailed half hourly data around the Events to audit performance and payment, which may include consumption and export data on an individual participant basis.

If you have a smart meter, consent may be renewed every 18 months after initial verification. If moving from the previously consented address, you must opt-out of the Service as soon as possible, and at latest the date of moving.

You may withdraw your consent to the sharing of your smart meter energy data at any time by withdrawing from the program contacting us via contacting our customer support team here:

If you withdraw your consent, we will stop accessing your smart meter data via the national smart metering system and will stop sharing your smart meter data with Programme Operators for future Events; as a result, you will no longer be able to participate in Services that require smart meter data, including flexibility or demand response services. Withdrawal of consent will not affect any data already shared or used lawfully before your withdrawal, or any data we are required to retain to meet legal, regulatory, or audit obligations.

We, our Partners, and approved sub processors on its behalf may share and process the above information for the purposes of operating WaEV Smart.

We and our Partners and/or authorised sub-processors shall retain settlement calculations and data regarding your participation in the Service as per the terms of each Grid Services’ program rules for up to seven years.

By entering the Service, you agree that your above information will be processed and used as such.

By entering the Service, you agree to receive communications from us or Partners in connection with your participation in the Services.
